Azurative LLC ("Azurative", "us", "we", or "our") operates the website at https://www.cloudradial.com and sites associated with our product delivery (the "Site").

This page describes our policies regarding the collection, use, and disclosure of personal data when you use our Site and the choices you have associated with that data. It also describes our use of Cookies.

We use your data to provide and improve the Site. By using the Site, you agree to the collection and use of information in accordance with this policy and to the provisions stated in the Terms of Service, which also governs the use of the CloudRadial.com website and are available at https://www.cloudradial.com/terms. Disputes relating to privacy and/or this Privacy Policy are subject to the Arbitration Agreement in the Terms of Service.

Definitions

Disclosure of Data

We may disclose your Personal Data in the following circumstances:

Third-Party Service Providers (Subcontractors): We engage subcontractors and third-party service providers to facilitate our Site and services. These parties have access to your Personal Data only to perform tasks on our behalf and are contractually obligated not to disclose or use it for any other purpose. Analytics and Monitoring Providers: Google, Mixpanel, LogRocket, Beamer, LinkedIn, Facebook, and Reddit, subject to their respective privacy policies.

Payment Processors: Stripe, Authorize.Net, and Zoho, in accordance with PCI-DSS standards. We do not store payment card details directly.

Platform Transactions: CloudRadial integration partners where required to facilitate connected platform features. In these cases, your usage of those platforms are governed by those provider’s privacy policy.

Business Transactions: In the event of a merger, acquisition, or asset sale, your Personal Data may be transferred. We will provide notice before your Personal Data becomes subject to a different Privacy Policy.

Legal Requirements: We may disclose your Personal Data when required by law or to protect the rights, property, or safety of Azurative LLC, our customers, or the public

Security of Data

We take reasonable and appropriate technical and organizational measures to protect your Personal Data from loss, misuse, unauthorized access, disclosure, alteration, and destruction. Your Rights and Access

You have the right to:

  • Access the Personal Data we hold about you
  • Request correction or erasure of inaccurate Personal Data
  • Object to or request restriction of further processing
  • Request portability of your Personal Data in a commonly used electronic format
  • Opt out of marketing communications at any time
  • Not receive discriminatory treatment for exercising your privacy rights

EU-U.S. Data Privacy Framework and UK Extension

Azurative LLC complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF as set forth by the U.S. Department of Commerce. Azurative LLC has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF. If there is any conflict between the terms in this Privacy Policy and the EU-U.S. DPF Principles, the Principles shall govern. DPF Principles

In compliance with the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF, Azurative LLC commits to process all personal data received from the EU and UK in accordance with the following DPF Principles:

  1. Notice: We inform individuals about the purposes for which we collect and use personal data, the types of third parties to whom we disclose it, and the choices and means we offer for limiting its use and disclosure.
  2. Choice: We offer individuals the opportunity to opt out of having their personal data disclosed to third parties or used for purposes materially different from those for which it was originally collected. For sensitive personal data, we will obtain affirmative express consent.
  3. Accountability for Onward Transfer: When we transfer personal data to third parties acting as agents on our behalf, we do so only for limited and specified purposes, require those parties to provide the same level of privacy protection as required by the DPF Principles, and take reasonable and appropriate steps to ensure they process personal data in a manner consistent with our DPF obligations. Azurative LLC remains liable under the DPF Principles if an agent processes personal data in a manner inconsistent with the DPF Principles, unless we prove we are not responsible for the event giving rise to the damage.
  4. Security: We take reasonable and appropriate measures to protect personal data from loss, misuse, unauthorized access, disclosure, alteration, and destruction.
  5. Data Integrity and Purpose Limitation: We limit the collection of personal data to information that is relevant for the purposes of processing, and do not process personal data in a way that is incompatible with the purposes for which it was collected.
  6. Access: Upon request, we will grant individuals reasonable access to personal data we hold about them, and will take reasonable steps to correct, amend, or delete data that is inaccurate.
  7. Recourse, Enforcement, and Liability: We provide individuals with independent recourse mechanisms to address complaints.

FTC Jurisdiction

The FTC has jurisdiction over Azurative LLC’s compliance with the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF.

Complaints

  • Please submit any complaints to us in the first instance. In compliance with the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF, Azurative LLC commits to resolve DPF Principles-related complaints about our collection and use of your personal data.  EU and UK individuals with inquiries or complaints regarding our handling of personal data received in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF should first contact Azurative LLC at: support@cloudradial.com.
  • You may also submit complaints to a free alternative dispute resolution provider. In compliance with the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF Principles, Azurative LLC commits to refer unresolved complaints concerning our handling of personal data received in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF to BBB National Programs, an alternative dispute resolution provider located in the United States. If you do not receive timely acknowledgment of your DPF Principles-related complaint from us, or if we have not addressed your complaint to your satisfaction, please visit https://bbbprograms.org/dpf-complaints for more information or to file a complaint. The services of BBB National Programs are provided at no cost to you.

Under certain conditions, you may invoke binding arbitration. If your complaint cannot be resolved through the above channels, under certain conditions, individuals may invoke binding arbitration for complaints regarding DPF compliance not resolved by any other DPF mechanism. Disclosure

As set out under “Disclosure of Data” below, we may disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

Your Choices

If we wish to use or disclose your personal data for purposes materially different from those described in this policy, or to disclose it to third parties not previously identified, we will provide you with the opportunity to opt out of such use or disclosure. Additional Provisions

Do Not Track: We do not support Do Not Track (DNT) signals.

Children's Privacy: Our Site does not address anyone under the age of 13. We do not knowingly collect personal data from children under 13.

Links to Other Sites: Our Site may contain links to third-party sites. We have no control over and assume no responsibility for the privacy practices of any third-party sites or services.

Behavioral Remarketing: We may use remarketing services to advertise on third-party websites based on your past visits to our Site using Cookies.

Changes to This Privacy Policy
